1. Acceptance of Terms

By accessing or using the MyTripDiary application and website at mytripdiary.com (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

MyTripDiary is a travel journal application that allows users to create and manage trip diaries, upload photos, write journal entries, track bookings and itineraries, and collaborate with other travelers. The Service includes AI-powered photo analysis features.

3. User Accounts

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You must be at least 13 years old to use the Service

4. User Content

You retain all ownership rights to the content you upload to the Service, including photos, journal entries, and trip data. By uploading content, you grant us a limited license to store, process, and display that content solely for the purpose of providing the Service to you.

You agree not to upload content that:

• Violates any applicable law or regulation
• Infringes on the intellectual property rights of others
• Contains malware, viruses, or harmful code
• Is abusive, harassing, or threatening
• Contains explicit or illegal material

5. AI Photo Analysis

The Service uses AI to analyze uploaded photos for automatic captioning, tagging, and scene detection. By using this feature, you consent to automated processing of your photos. AI-generated descriptions are provided as suggestions and may not always be accurate. You can edit or remove AI-generated content at any time.

6. Trip Sharing and Collaboration

When you invite others to collaborate on a trip, they will be able to view and potentially edit trip content based on the permissions you grant. You are responsible for managing access to your trips. We are not liable for actions taken by users you have invited to your trips.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service
• Use automated scripts to access the Service without our permission
• Reverse-engineer or attempt to extract source code from the Service

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue features with reasonable notice. We are not liable for any data loss resulting from service interruptions, though we take reasonable precautions to protect your data.

9. Termination

You may delete your account at any time through the Settings page. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be handled as described in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, MyTripDiary shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved in the courts of Sweden.
